Vice President Kamala Harris has recently emphasized the importance of the Affordable Care Act (ACA), also known as Obamacare, particularly for Latino communities. Her campaign asserts that former President Donald Trump intends to dismantle this healthcare law, a statement that was highlighted in a recent campaign advertisement.

In the advertisement released on September 27, 2024, a healthcare provider expresses his dedication to community health and describes how the ACA has enabled many families to access essential healthcare. The ad includes a past statement from Trump where he mentions “repealing and replacing Obamacare,” followed by the healthcare provider’s remark that removing the ACA would leave millions without health insurance. The ad also aired in Spanish, reflecting Harris’s focus on reaching Latino voters.

The statement in the ad aligns somewhat with Trump’s historical stance on the ACA, though his current position seems less clear-cut. Trump has previously expressed opposition to the ACA, having taken steps to diminish its reach during his presidency, but his approach has since evolved. His initial opposition to the ACA, enacted in 2010, was reflected in his 2016 presidential campaign when he called for the law’s repeal.

In 2017, shortly after taking office, Trump told Republican members of Congress that repealing the ACA would be an early priority in his administration. He described the ACA as flawed and said his aim was to protect families from rising premiums and other challenges. At that time, Trump supported Republican-led congressional initiatives, such as the American Health Care Act, which sought to replace ACA subsidies and regulations. Although the House passed this bill in May 2017, it ultimately failed in the Senate. Trump’s administration later requested the U.S. Supreme Court to invalidate the ACA, though the court dismissed the case.

In addition to legislative attempts, Trump’s administration worked to reduce ACA enrolment, decreasing funding for outreach, marketing, and assistance. His administration also expanded access to short-term, limited-coverage health plans, sometimes referred to by Democrats as “junk insurance,” arguing that these plans were less comprehensive and could result in surprise medical bills. As a result, during Trump’s presidency, ACA enrolment dropped by over 2 million, and the uninsured population rose by 2.3 million.

For his 2024 presidential campaign, Trump’s stance on the ACA has been somewhat inconsistent. He has at times indicated an interest in replacing the ACA with an “alternative” approach, while at other times, he has suggested he wouldn’t completely terminate it. In March, he posted on his social media platform Truth Social that he didn’t plan to eliminate the healthcare law but instead sought to make it more efficient and affordable. During a September 10 debate with Harris, Trump remarked that he has ideas for a new plan and would run the ACA “as well as it can be” until his plan is implemented. However, he has yet to clarify the specifics of this proposed plan.

A spokesperson for Trump’s campaign has also stated that he aims to implement “real solutions” for American healthcare without relying on large insurance and pharmaceutical companies, though they did not elaborate on what these solutions might entail.

Harris’s campaign referenced Project 2025, a policy proposal guide by a conservative think tank, as evidence supporting its claim about Trump’s stance on the ACA. Project 2025 outlines several changes to the ACA, such as reversing FDA approval for certain drugs used in reproductive health, restricting no-cost emergency contraception options, and modifying the subsidized insurance market. However, the document does not call for an outright repeal of the ACA. Trump has distanced himself from Project 2025, and his campaign platform does not address the ACA directly.

In light of this complex backdrop, Harris’s campaign asserts that Trump intends to remove the ACA. However, Trump’s public statements about the ACA vary, with some comments supporting the law’s replacement, others implying improvements, and little detail provided about his specific healthcare plan.
